Terms & Conditions of Eyecatchers Luxe (ECLNL)

These general terms and conditions apply to all transactions (including product offers, purchases, and sales) conducted by EYECATCHERS LUXE (ECLNL) on or via this website. By accessing or using this website, you agree to be bound by these terms and conditions.

1. Transactions

A sales agreement between you (the consumer/buyer) and EYECATCHERS LUXE (the seller) is concluded when you place an order on this website.

We accept direct online orders from consumers residing in the European Union (EU), European Economic Area (EEA), Monaco, and the United Kingdom (UK). For countries outside these regions, refer to Article 6.

By clicking “Place Order” during checkout, you enter a legally binding contract and confirm your acceptance of these Terms & Conditions, the Privacy Policy (Article 7), and the Return Policy (Article 5).

2. Payment Information

EYECATCHERS LUXE uses Shopify Payments to securely process your payment information. All data transmitted over the internet is protected by encryption. After placing your order, you will be redirected to a secure payment page for finalization. Once payment has been successfully completed, a confirmation will appear on-screen and be sent to your registered email address.

3. Product Information

EYECATCHERS LUXE offers pre-owned designer fashion items. The trademarks of these items remain the intellectual property of their respective brand owners. No brand owner is affiliated or associated with EYECATCHERS LUXE or ECLNL.

All products listed for sale have been authenticated by in-house experts and, when applicable, verified using Entrupy technology. EYECATCHERS LUXE guarantees the authenticity of all products sold on this website.

The second-hand luxury fashion items offered by us are sold in the condition they are in at the time of sale. Pre-owned products may exhibit visible or other imperfections as a result of previous use, storage, or age.

Each item description on the website is accompanied by photographic documentation for accuracy; however, color variations or visual differences may occur due to technical display limitations. Product condition assessments reflect EYECATCHERS LUXE’s professional opinion and are inherently subjective. We are not liable for typographical or listing errors except in cases of gross negligence.

Liability for material or immaterial damage resulting from the use of the products is excluded to the extent permitted by law. Given the used nature of the products, the legal warranty may be limited; warranty claims can therefore not go beyond the obligations as set out in Dutch law for second-hand goods. These goods are best considered collectibles. Customers are advised to inspect the products carefully before purchasing.

Any possible claim under warranty or guarantee must be reported no later than 12 months after the purchase agreement is concluded.

Products listed may also be offered simultaneously on other sales platforms. Should an item become unavailable due to inventory overlap, we reserve the right to cancel the order, notify you via email, and issue a full refund. Similarly, we reserve the right to cancel orders containing clear pricing errors or discrepancies.

All prices are displayed in Euro (€) and include sales tax under the Dutch Margin Scheme for second-hand goods. Consequently, VAT is not itemized on invoices. Shipping costs are calculated during checkout, if applicable.

4. Delivery Information

Orders are dispatched within three (3) business days following confirmed payment. Once your order has been shipped, you will receive an email containing your order number, tracking number, and a direct link to the shipping provider.

Estimated delivery time within the EU is typically 2–4 business days from the date of shipment. Shipments are handled primarily via PostNL, DHL or DHL Express.

Products are shipped in neutral outer packaging. For discretion and security, our secondary trade name “ECLNL” is used on parcel documentation and return details.

Ownership and risk transfer to the buyer occur upon confirmed delivery—via signature or a verified digital delivery proof.

Please note:

Delivery addresses cannot be modified after order confirmation without cancellation.
Shipments cannot be rerouted once dispatched.
Buyers are responsible for providing accurate and complete shipping information. Liabilities arising from undeliverable parcels or failed delivery attempts due to incomplete addresses or unclaimed parcels are borne by the buyer.
Deliveries cannot be made to PO box addresses.

5. Return Policy

For online orders within the EU/EEA and UK, buyers have the statutory right of withdrawal within 14 days from the date of delivery.

To initiate a return, please email a completed withdrawal form (available under “Return Policy” at the bottom of our website) to info@eyecatchersluxe.com.

Transactions concluded in person, such as through a Personal Service Appointment or Personal Sale, are excluded from the right of withdrawal.

Returned items must be in the same condition as delivered, complete with all accessories, packaging, paperwork, and security labels (if applicable). For select items, EYECATCHERS LUXE uses tamper-proof security tags (ID360Tags). Once removed, these cannot be reattached and signify acceptance of the purchase by law, thereby excluding these items from return eligibility.

Buyers are responsible for return shipping costs and assume all risks during return transit. For safety, returns should be sent using a registered, fully insured service. Returns must be received by EYECATCHERS LUXE within 14 days of the return notification to qualify for refund.

Upon receipt and successful inspection, refunds are issued within 14 days to the same account used for the original payment. All refunds are made in Euro (€). EYECATCHERS LUXE is not responsible for currency exchange rate fluctuations.

Orders outside the EU/EEA, Monaco and the UK are final after payment and not eligible for return.

6. Non-EEA, UK or Monaco Buyers

EYECATCHERS LUXE ships, on request, to selected non-EEA countries. For availability and quotation, contact us via WhatsApp, the online form, or info@eyecatchersluxe.com.

Transactions outside the EU/EEA are subject to these same Terms & Conditions, except for the following adjustments:

All non-EEA purchases are final and non-returnable.
Only the United Kingdom and Monaco qualify for returns outside the EEA.
Buyers are solely responsible for all import duties, taxes, and fees in their destination country. EYECATCHERS LUXE does not under-declare or alter shipment values.
We are not responsible for delivery delays related to customs clearance.
For security reasons, payment must be made exclusively by bank transfer.

7. Privacy Policy

By using our website, you consent to the processing of your personal data as described in our Privacy Policy.

EYECATCHERS LUXE processes data in accordance with Dutch and EU regulations, solely for legitimate purposes such as order fulfillment, transaction completion, fraud prevention, and marketing communications.

Data processing occurs through the infrastructure of Shopify Inc., our e-commerce platform provider. Your email address may be used for newsletters or marketing communications, from which you may unsubscribe at any time. We will never sell or rent your personal information to third parties.

Third parties—such as couriers, payment processors, and financial institutions—receive only the data necessary to perform their duties. Where required by law, we may disclose personal information to government authorities.

8. Personal Service Appointments

Purchases made during a Personal Service Appointment are considered a personalized and in-person sales service. These transactions are treated as custom purchases concluded face-to-face and are therefore excluded from the right of withdrawal and not eligible for return. All sales completed in this context are final and cannot be refunded.

9. Other Provisions

We reserve the right to cancel any order in the event of a violation of these Terms & Conditions, suspected fraud, or other criminal activity.

10. Legal Information

These Terms & Conditions are governed by and construed under Dutch law. Parties may submit disputes arising from this agreement to the competent court in The Hague, unless otherwise agreed in writing.

For EU-based consumer disputes, we observe the Consumer Protection Cooperation (CPC) Regulation (EU) 2017/2394, the ADR Directive 2013/11, and ODR Regulation (EU) No. 524/2013.

EYECATCHERS LUXE and ECLNL are registered trade names in the Netherlands, listed with the Dutch Chamber of Commerce (KvK) under registration number 84808559.

The EYECATCHERS LUXE name, logo, and logo composition are protected by copyright and trademark law. Unauthorized reproduction, distribution, or use is strictly prohibited.

Brand trademarks remain the property of their respective owners and are unaffiliated with EYECATCHERS LUXE or ECLNL.

Should any provision of these Terms be declared invalid or unenforceable, the validity of the remaining clauses shall not be affected.
