Terms & Conditions of Eyecatchers Luxe (ECLNL)

These general terms and conditions apply to all transactions (such as product offers, purchases and sales) of EYECATCHERS LUXE (ECLNL) on and/or via this website. By using this website, you agree to be bound by these terms and conditions.

1 Transactions

A sales transaction between you as a consumer/buyer and EYECATCHERS LUXE as a seller, as governed by these General Terms and Conditions, is concluded when you place an order on this website.

We accept direct orders through this website from consumers in the countries of the European Union (EU) and the European Economic Area (EEA). For countries outside the EEA, please refer to point 6 below.

Your order is legally binding by clicking the "place order" button during checkout. By placing such an order, you agree to accept these Terms and Conditions, including all other rules such as stated under Privacy Policy (7) and Return Policy (5).

2 Payment Information

EYECATCHERS LUXE uses Shopify Payments to protect your payment information when you use our site, which encrypts and protects the data you transmit over the internet. After placing your order, you will be directed to a secure payment page and asked to pay for your order. You will receive an electronic order confirmation on your screen and by email as and after your payment has been processed.

3 Product Information

EYECATCHERS LUXE offers second-hand branded fashion products on this site. Trademarks of these products are the property of their respective brand owners. No brand owner has any association or affiliation with EYECATCHERS LUXE or ECLNL.

All items offered for sale are determined authentic, by in-house expertise and Entrupy (if applicable). Pre-owned may have visible and invisible imperfections due to age, use or storage. The goods we offer should primarily be seen as collector's items. EYECATCHERS LUXE guarantees the authenticity of the products for sale on this website. All warranties are limited to a duration of 1 year.

Each item offered on this website is unique with individual features indicated in a product description that is accompanied by digital photography as part of the description. EYECATCHERS LUXE strives for the best possible representation of its products, product images and descriptions. Condition assessments are the subjective opinion of EYECATCHERS LUXE. Image quality and color accuracy may differ from the actual product due to technical limitations. We are not liable for accidental errors in product listings, except in cases of gross negligence.

EYECATCHERS LUXE can offer its products via various platforms. Should it happen that an ordered product is not available or no longer available due to a delay in stock synchronization, we reserve the right to cancel this order, notify you by email and issue the refund. In the event of a pricing error, we also reserve the right to cancel a transaction, notify you via email, and issue a refund.

All our prices are in Euro (€) and do not include delivery costs, if applicable.

Shipping costs are calculated at checkout.

All offers on this site are second-hand products. Our prices include sales tax. In the context of the margin scheme for taxable resellers of second-hand products, we do not issue tax-specified invoices, in accordance with the Dutch Tax Act.

4 Delivery Information

After your payment has been processed, we will ship your order within 3 business days.
When we ship your order, you will receive an email with your order number, tracking number, and a link to the carrier's website.
It takes about 2-4 business days to deliver your order within the EU, after shipment.
We usually ship our orders with PostNL or DHL Express.
We ship our products in neutral outer packaging and use our secondary trade name, ECLNL, for added anonymity and security during transit to our customers and for returns.

From the moment of delivery to the buyer or its designated representative, by means of a signature or other equivalent, such as a digital proof of delivery, responsibility for the purchased item(s) passes to the buyer.

We cannot change your delivery address after checkout without cancelling the order, nor can we cancel or reroute a shipment after it has been shipped.

The buyer is responsible for providing complete and accurate shipping information. The buyer is therefore liable for all costs arising from an undeliverable shipment, or the inability of the consignee to accept a personal delivery to the address provided or, if applicable, to a relevant collection point.

Shipping to PO Box addresses is not possible.

5 Return Policy

For online purchases within the EU/EEA and the UK, buyers can exercise their legal right of return (right of withdrawal) within 14 days of the time of delivery. To initiate a return, you must notify us by sending us a completed return form by email. You can find this form available for download at the bottom of the website under "Return Policy". Send this form to info@eyecatchersluxe.com.

Excluded from the right of withdrawal and return, are transactions that are concluded during a physical in-person Personal Service Appointment / Personal Sale.

In order to be refunded (in full), you must return the item(s) to EYECATCHERS LUXE in the same condition as sent, including all product accessories, packaging, paperwork and with all attached labels*, if applicable, as delivered. For certain products, we use tamper-proof security labels* (ID360Tags), which the buyer can safely remove with scissors, but cannot be reattached afterwards. These labels are specifically designed for these products to give the buyer the opportunity to inspect and try on the product. After this label is removed by the purchaser, the item is formally accepted and/or accepted for use by operation of law and is therefore further excluded from return.
For a safe return, please use the shipping carton and the filling materials used for delivery. It is the buyer's responsibility to pay for shipping costs and cover risks of the return. The buyer is personally liable if the product is lost or damaged during transport to us. For your safety, use a registered and a fully insured carrier option. Your return must be returned to us within 14 days of receiving the return notification in order to be eligible for a refund.

Once we have received the return, after inspection and confirmation that everything is in order, we will refund the purchase price within 14 days to the same account from which the purchase was made, in the original purchase transaction. EYECATCHERS LUXE is not responsible for any exchange rate fluctuations between the amount paid in Euro (€) and any alternative currency used by the buyer.

All refunds will be made in Euro (€) only.

Orders from outside the EU/EEA and UK are final after payment and are not eligible for return.

6 non-EEA/UK buyers

EYECATCHERS LUXE ships to selected countries outside the EU. These are transactions at the request of the buyer and are processed on an individual basis. Contact us via WhatsApp or the form on our website, for more information or send an email to info@eyecatchersluxe.com.

Please note that transactions with buyers outside the EU/EEA are governed by these terms and conditions, with the following exceptions:

Sales to customers outside the EU/EEA are final and not eligible for return. The United Kingdom is the only country that is eligible for returns outside the EEA.
All non-EEA buyers are fully responsible for paying all taxes and duties for importation into their destination country. (We will not declare shipments. Please contact your local customs office in advance to determine any fees.
We are not responsible for customs related delivery delays.
For security reasons, buyers from non-EEA countries are required to pay exclusively by bank transfer.

7 Privacy Policy

EYECATCHERS LUXE recognizes the concerns of its online visitors and customers about privacy. We work in accordance with Dutch and EU laws and regulations. We will only process personal data for specific and legitimate purposes. This data is necessary to process orders and complete transactions on our website and for relevant related marketing purposes.

By using this website, you agree that your data will be processed through the technological infrastructure of Shopify Inc. used by us.
We may use your email address for our newsletters and marketing purposes. You can unsubscribe from these services at any time. We will never sell your data to a third party without your permission.

Third parties, such as courier services, banks, credit card service providers, will only receive relevant information to fulfill their intended function. For the purpose of fraud prevention and verification, we may securely transfer the necessary personal information to payment service providers, transport companies and, if required to do so, to official authorities/governments.

8 Other provisions

Any violation of these Terms and Conditions entitles us to cancel the sale. We reserve the right to cancel a transaction in the event of fraud or reasonable suspicion of criminal activity.

9 Legal Information

These General Terms and Conditions between the buyer and EYECATCHERS LUXE are governed by Dutch law. For intra-European dispute resolution, we follow Consumer Protection Cooperation (CPC) Regulation (EU) 2017/2394, as well as the ADR Directive 2013/11 and ODR Regulation (EU) No. 524/2013.

EYECATCHERS LUXE and ECLNL are registered trade names for our company, based in the Netherlands, both trade names are registered with the Dutch Chamber of Commerce in The Hague (KvK) under number: 84808559.

All rights to the name, logo and spelling EYECATCHERS LUXE are protected by copyright and registered as trademarks. Any breach of this will be prosecuted. Reproduction and/or distribution of content from this website is not permitted.

Trademarks are the property of their respective brand owners. No brand owner has any association or affiliation with EYECATCHERS LUXE or ECLNL.

If a court decision declares any provision of these terms and conditions invalid, the validity of the remaining provisions shall remain unaffected.
