These general Terms and Conditions cover all use of commercial transactions (product offers and sales) at EYECATCHERSLUXE (or ECLNL).  By using this website, you agree to be bound by these Terms and Conditions.

 

1 Transactions

A transaction between you as consumer/buyer and EYECATCHERSLUXE as seller, as governed by these Terms and Conditions, is concluded when you place an order on this website. We accept direct orders through our website from consumers based in the European Union (EU) and European Economic Area (EUA) countries.

We do not accept orders from the following territories:

• Netherlands: Aruba, Curacao, Sint Maarten, Bonaire, Sint Eustatius and Saba
• Denmark: Faroe Islands and Greenland
• Finland: Åland Islands
• France: Guadeloupe, Martinique, Réunion and Mayotte
• Germany: Helgoland and Büsingen
• Spain: Ceuta, Melilla and Canary Islands
• Italy: Livigno, Campione d’Italia and Italian zone of the lake of Lugano
• Greece: Mount Athos
• San Marino

Your order is legally binding by clicking “submit order” during the checkout process. By submitting an order, you agree to accept these Terms and Conditions, including all policies such as the Privacy Policy and Return Policy sections.

 

2 Payment Information

EYECATCHERSLUXE uses Shopify Payments to protect your payment information when you use our site, which will encrypt and protect the data you send over the internet.

After submitting your order, you will be referred to a secure payment page and you will be asked to pay for your order.

You will receive an electronic order confirmation on your screen and per e-mail when and after your payment has been processed.

 

3 Product Information

EYECATCHERSLUXE offers pre-owned brand name fashion products. Trademarks are owned by their respective brand owners. No brand owner has any association or and/or affiliation with EYECATCHERSLUXE or ECLNL.

All the items for sale are assessed authentic, pre-owned and may have imperfections due to age, use or storage. EYECATCHERSLUXE guarantees the authenticity of the items for sale on this website.

Each item offered on this website is unique with individual characteristics which are reflected in a product description that is accompanied with digital photography as part of the description. EYECATCHERSLUXE is committed to a best effort representation of its products, product images and descriptions. Condition assessments are the subjective opinion of EYECATCHERSLUXE. Image quality and color accuracy may vary from the actual product due to technical limitations. We are not liable for accidental errors contained in product listings, except in case of gross negligence.

EYECATCHERSLUXE may offer its products through various platforms. Should it occur, that a product ordered, is not or no longer available due to a delay in inventory synchronization, we will retain the right to cancel this order, inform you via email and issue the refund. In the event of a pricing error, we also retain the right to cancel a transaction, inform you via email and issue a refund.

All prices are made in Euro (€) and exclude delivery costs, if applicable.

Shipping cost are calculated at checkout.

All offerings on this site are pre-owned products. Our prices are incl. VAT tax. We do not issue tax specified invoices, in compliance with Dutch tax code, under the margin scheme regulation for taxable dealers of second-hand products.

 

4 Delivery Information

• After payment is processed we ship your order within 2 working days.
• When we dispatch your order, you will receive an e-mail including your order number, tracking number and a link to the courier’s website.
• It takes approximately 2-4 working days to deliver your order within EU.
• We ship with PostNL or DHL.
• We send our products in bland outer packaging and use our secondary trade name, ECLNL, for additional anonymity and security during transit to our customers and for return shipments.

 

From the moment of delivery to buyer or representative, by signature or any equivalent, such as digital proof of delivery, the responsibility for the purchased item(s) passes to the buyer.

We cannot change your delivery address after checkout, without cancelling the order, neither can we cancel or redirect a shipment after dispatch.

The buyer is responsible to provide complete and accurate shipping information. The buyer is therefore liable for all costs resulting from an undeliverable shipment or the addressee’s inability to accept a in person delivery to the provided address, or if applicable from any relevant pickup point.

We do not ship to P.O. boxes.

 

5 Return Policy

For online purchases within the EU/EUA you can exercise your legal right to return within 14 days after the moment of delivery. To initiate a return, you need to notify us by sending us filled out return form by email. You can find this form available for download at the bottom of our website in the Return Policy section. Please send the notification to info@eyecatchersluxe.com.

It is important to note, that to be (fully) refunded, you need to return the item(s) to EYECATCHERSLUXE in the same condition, including, all product accessories, packaging, paperwork and with all labels attached, if applicable, as delivered to you.

We use tamper-proof security labels for certain products, which the buyer can safely remove with scissors, but are impossible to reattach thereafter. These labels are specifically designed for our products to give the buyer the opportunity to inspect and try on your product. If this label is removed by the buyer, the item has formally been altered and/or accepted into regular use, therefore is legally excluded from return.

For safe return shipping please use the shipping box and fill materials used for delivery. It is the buyer’s responsibility to cover return shipping costs and risks, the buyer is liable if the product goes missing or gets damaged during transit back to us. Please use "a signed for on delivery" and fully insured carrier option for your safety. Your return must be shipped back to us within 14 days after the return notification is issued to be eligible for a refund.

As soon as we have received your return shipment, after inspection and confirmation that all is in good order, we will issue the refund within 14 days.

We will credit the refundable amount exclusively to payment method used by the buyer for the original transaction. EYECATCHERSLUXE is not responsible for any currency fluctuations between the paid amount in Euro (€) and any possible alternative currency used by the buyer.

All refunds are exclusively made in Euro (€).

Orders made from outside the EU/EUA are final and are not eligible for return.

 

6 Non-EUA Buyers

EYECATCHERSLUXE does ship to selected countries outside the EUA. These are transactions are per buyer request and are processed on an individual basis. Please contact us through the form on our website, for more information or email to eclnl@outlook.com.

Please note transactions to buyers located outside the EU/EUA are covered by these Terms and Conditions with following exceptions:

• Sales to customers outside the EU/EUA are final and not eligible for return.
• All non-EUA buyers are fully responsible to pay all taxes and duties for import to their destination country. (We will not under declare shipments. Please check with your local customs office to determine any costs beforehand.)
• We are not responsible for customs related delivery delays.
• Buyers from non-EUA countries are required to pay by bank transfer for security reasons.

 

7 Privacy Policy

By using our website, you agree with our Privacy Policy:

EYECATCHERSLUXE recognizes the concern of its online visitors and clients regarding privacy. We work in compliance with Dutch and EU legislation and regulations. We will process personal data only for specific and legitimate purposes. This data is necessary to process orders and to complete transactions on our website and relevant connected marketing purposes.

By using this website you agree that your data is processed through Shopify Inc. technological infrastructure.

We may use your e-mail address for our newsletters and marketing. You can always unsubscribe these services. We will never sell your data to a third party without your consent.

Third parties, such as shipping couriers, banks, credit card service providers, will only receive relevant information for the purpose of fulfilling their intended function. For the purpose of fraud prevention and verification, we may securely transfer necessary personal information to payment service providers, shipping companies and official authorities.

 

8 Remaining Provisions

Any material breach of these Terms and Conditions gives us the right to cancel the sale.

We retain the right to cancel a transaction in any case of fraud or reasonable suspicion of criminal activity.

 

9 Legal Information

The Terms and Conditions between the buyer and EYECATCHERSLUXE, are governed by the laws of the Netherlands. For intra-European transaction dispute resolution we follow Consumer Protection Cooperation (CPC) Regulation (EU) 2017/2394 as well as the ADR Directive 2013/11 and ODR Regulation (EU) No 524/2013.

EYECATCHERSLUXE and ECLNL are registered trade names for our company, based in the Netherlands, both trade names are registered with the Dutch Chamber of Commerce in The Hague (KvK) 84808559.

All content on EYECATCHERSLUXE is copyright and trademark protected. No reproduction or content distribution from this website is permitted.

Trademarks are owned by their respective brand owners. No brand owner has any association or and/or affiliation with EYECATCHERSLUXE or ECLNL.

If, by court decision, a provision of these Terms and Conditions is ruled invalid, the validity of the remaining provisions shall remain unaffected.
